Terms of Service

1. Acceptance of Terms

By accessing or using the Bolora platform, APIs, SDKs, or any associated services (collectively, the "Service"), you ("Partner" or "you") agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

These Terms apply to all Bolora Partners — SaaS companies and developers who integrate Bolora's AI Voice Infrastructure into their products to serve their own customers ("End Users").

2. Description of Service

Bolora Technologies ("Bolora", "we", "us", or "our") provides an AI Voice Infrastructure platform that enables SaaS companies to embed AI-powered voice capabilities — including inbound and outbound call handling, speech-to-text, text-to-speech, natural language understanding, and related services — into their products via our REST API and SDKs.

You are responsible for your End Users' use of the Service when accessed through your integration. You agree to ensure your End Users comply with these Terms and any applicable Bolora policies.

3. Partner Account

To use the Service you must register for a Bolora Partner account. You agree to: (a) provide accurate and complete registration information; (b) keep your API keys and credentials confidential; (c) immediately notify Bolora of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

4. Permitted Use

You may use the Service only for lawful business purposes in accordance with these Terms. You agree not to:

  • Use the Service to place unsolicited calls (spam) or conduct robocalling in violation of applicable law (including TCPA, TRAI regulations, or equivalent)
  • Use the Service to impersonate individuals or organizations without authorization
  • Use the Service to generate, distribute, or facilitate illegal, harmful, abusive, or fraudulent content
  • Reverse engineer, decompile, or attempt to extract Bolora's proprietary models or systems
  • Resell or sublicense the Service except as expressly permitted under a separate Partner reseller agreement
  • Attempt to circumvent usage limits, access controls, or billing systems

5. Pay-as-you-Go Billing

The Service is billed on a pay-as-you-go basis, measured in minutes of AI voice conversation generated through your integration. Billing details, current per-minute rates, and volume tier schedules are provided in your Partner dashboard and in the Pricing documentation available at bolora.in/pricing.

By using the Service, you authorize Bolora to charge your payment method on file for all usage incurred during each billing cycle. Invoices are generated at the end of each calendar month. All fees are non-refundable except as described in our Cancellation & Refund Policy.

Bolora reserves the right to update pricing with 30 days' written notice to your registered email address. Continued use of the Service after a price change constitutes your acceptance of the new rates.

6. Intellectual Property

Bolora and its licensors retain all intellectual property rights in the Service, including but not limited to our AI models, APIs, SDKs, infrastructure, and platform. These Terms do not transfer any ownership rights to you.

You retain ownership of your own data, your product, and your customer relationships. By using the Service, you grant Bolora a limited, non-exclusive licence to process data you submit solely to provide and improve the Service.

7. Data and Privacy

You are responsible for obtaining all necessary consents from your End Users for the collection, processing, and transmission of voice data through the Service. You agree to maintain a privacy policy that accurately describes your data practices and complies with applicable privacy laws (including GDPR, DPDP Act 2023, CCPA, or equivalent).

8. Service Availability

Bolora will use commercially reasonable efforts to keep the Service available, but does not guarantee any specific level of uptime and provides the Service on an "as available" basis. Standard pay-as-you-go partners are not entitled to refunds, cash compensation, or service credits for downtime, latency, or service interruptions. A guaranteed uptime commitment (SLA) is available only to Enterprise Partners under a separate signed agreement — contact hello@bolora.in.

Bolora reserves the right to suspend or terminate access if: (a) your account is in breach of these Terms; (b) there is evidence of fraud or misuse; (c) required by applicable law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BOLORA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLORA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO BOLORA IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL BOLORA BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bolora and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from: (a) your use of the Service; (b) your End Users' use of the Service through your integration; (c) your violation of these Terms or applicable law.

12. Termination

Either party may terminate these Terms at any time for any reason with 30 days' written notice. Bolora may terminate immediately for material breach. Upon termination, your right to access the Service ceases. Outstanding balances remain due. Sections 6, 9, 10, 11, and 13 survive termination.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

14. Changes to Terms

Bolora may modify these Terms at any time. We will notify you via email or a notice in your Partner dashboard at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
